The 2018 Constitutional Court Ruling
In September 2018, South Africa's Constitutional Court handed down a landmark ruling in Minister of Justice and Constitutional Development v Prince. The court found that the prohibition on the private use and cultivation of cannabis by adults in a private space was an unjustifiable infringement on the right to privacy under Section 14 of the Constitution.
This means that South African adults may privately cultivate cannabis plants, possess cannabis for personal use, and use cannabis in a private space — without criminal sanction. The ruling does not legalise the commercial sale of cannabis or cannabis products (except CBD compliant with SAHPRA thresholds), but it fully protects home cultivation and personal use.
CBD Oil & SAHPRA Regulations
The South African Health Products Regulatory Authority (SAHPRA) rescheduled CBD in May 2019. CBD products containing less than 0.001% THC per final product are now classified as Schedule 0 (complementary medicine) and are available legally without a prescription in South Africa.
